In major setback for Mamata govt, Calcutta HC allows BJP to hold its 3 rath yatras in Bengal

In a major setback for the West Bengal government, the Calcutta High Court has set aside the Bengal government’s denial of permission to the BJP to hold three rath yatras in the state.
The court however has imposed several restrictions on the BJP while allowing them to hold the yatras.
“Petitioner has to inform the authorities atleast twelves hours before entering the area, should not hinder transport movement and maintain peace. In case of wrongful loss or damage to property the petitioner will be liable,” single bench judge Tapabrata Chakraborty said.
Chakraborty further instructed the police to ensure the adequate deployment of forces so that there is no breach of law and order.
The yatras are expected to criss-cross the state before the general elections next years.

“The administrative authorities totally denied permission without even making an endeavour that the rally can be allowed by imposing reasonable restrictions. This court can easily interfere with such decisions in exercise of its powers, when decisions are whimsical and illogical,” the court said, referring to the order issued by the state government on December 15 this year.
The BJP's state unit meanwhile welcomed the court’s decision.
“This is a moral victory of the BJP. We had full faith in the judiciary and today the court ruled in favour of us. The state government is trying to bulldoze the democratic rights of all opposition parties in the state,” said BJP leader Joyprakash Majumdar.
Majumdar said that the yatras are likely to be held on December 22, 24 and 26 this year.
“As per the earlier schedule, all three rath yatras will be held. The three locations are Coochbehar, Tarapith and Gangasagar. However we may consider changing dates of the rath yatra(s) as the court has not specified any dates for us,” Majumdar said.
